General Rules

 

1.         All business of Local 111 shall be kept private from any persons not members of Local 111. Any member found guilty of divulging or exposing any of the business, Local 111 shall be subject to a fine when found guilty by the UA Manual of Trial Procedures.

 

2.         Per the UA’s policy, Local 111 requires, that any bylaw amendments be proposed by a minimum number of twenty (20) members in writing with signatures, and the bylaws then can be read at three successive meeting, followed by a vote which must pass by two-thirds majority of members voting. This should only take place if and when members submit a properly supported proposal to amend.

 

3.         Any Officer of Local 111 may call a special meeting with the Business Manager’s approval. All members shall be properly notified.

 

4.         Any Officer not attending three consecutive committee meetings, without notifying the Business Manager/Financial Secretary, President or the Recording Secretary may be subject to charges and removed from office by the Executive Board in accordance with the procedures of Section 127 of the UA Constitution.  Any vacancy shall be filled by the President.

 

5.         Local 111 shall hold a general monthly meeting on the last Thursday of every month, except the month of December, the monthly meeting shall be the second Thursday, meeting starting at 7:30 PM EST at the principal office location or as designated. Local 111 may hold other informational meeting at other locations within Local 111’s jurisdiction when the need arises. There shall be no membership meeting in the month of November, unless there is a special called meeting.

 

6.         The conduct of meetings of Local 111 shall be governed by Robert’s Rules of Order and common sense.

 
 

 

Union Dues & Working Assessments

 

 

1.         The Business Manager/Financial Secretary, Business Agents, Organizer, President, Vice-President, and Recording-Secretary shall pay their monthly dues.

 

2.         All dues should be paid at the regular meetings. Members working out of the area on Travel Cards and Contractor Members may pay their dues by mail to one of the Local 111 offices.

 

3.         Working Assessment and other deductions shall be deducted by the employers according to the U.P. UNION AGREEMENT.

 

Working Rule

 

           

 

1.         No member shall install work coming under the U.A Jurisdiction (for personal gain) or for any one not signatory to the U.P. UNION AGREEMENT, except on their own property.

 

 

 

Principal Office

 

 

1.         The principal office of Local 111 shall be located in Escanaba, Michigan. Sub-offices may be established by the Business Manager/Financial Secretary as the needs of Local 111 require.

 

 

 

Business Manager/ Financial Secretary

 

 

1.                  The Business Manager/Financial Secretary shall appoint all paid non-elected positions of Local 111. (Organizer, Assistant Financial Secretary, Secretaries, etc.)

 

2.                  The Business Manager/Financial Secretary shall have the authority to layoff or terminate any appointed or hired employee of Local 111 for failure to perform their duties as required, or if economic or financial conditions warrant.

 

3.                  The Business Manager/ Financial Secretary or Business Agents shall have authority to examine paychecks of members of the U.A. working within the jurisdiction of Local 111.

 

4.         Stewards shall be appointed by the Business Manager/Financial Secretary or Business Agents. If a steward is not appointed, the members on the job may elect one.

 

5.         The Business Manager/Financial Secretary and Business Agents should inform the stewards of their duties when hired on the job and introduce the steward to the employer.

 

6.         The Business Manager by virtue of his office shall be a Trustee for the Pension and Health / Welfare Funds.

 

7.         Per the UA Constitution the Business Manager shall be Chairman of the Negotiating Committee.

 

           

 

Steward’s duties

 

 

1.         Check Union Dues Card of members once a month.

 

2.         Shall have authority to discuss work jurisdictions with other stewards when there are jurisdictional disputes.

 

3.         New employees shall report to the steward before starting work.

 

4.         The Steward shall report all accidents or sickness of employees on their job to Local 111.

 

 

 

Elections

 

 

1.         All elections shall be secret ballot once every three years.

 

2.         All elections shall be held on Saturdays at the principal office of Local 111 for the convenience of the members or a mail ballot may be allowed in accordance with the U.A. Constitution.

 

3.         Nominations shall be held in October, with the approval from the UA. Elections shall be held in December.

 

4.         Notification of Nominations and Elections shall be governed by the U.A. Constitution.

 

5.         Eligibility of members to run for office and to vote shall be governed by the U.A. Constitution.

 

6.         Election Committee shall consist of three members. One member shall be appointed by the Business Manager/Financial Secretary, one member shall be appointed by the President and one member shall be appointed by the Executive Board.

 

7.         A member must be present at the nominations’ meeting to accept a nomination for office. If a member cannot be present at the nomination’s meeting, the member must send written notice prior to the nominations’ meeting indicating what office they would accept nominations for.

 

8.         The offices of Local 111 shall be in compliance with the U.A. Constitution. Elections shall be held for the positions of Business Manager/Financial Secretary-Treasurer, Business Agent, President, Vice-President, Executive Board, Recording Secretary, Finance Committee, Examining Board, Inside Guard, and Trustee for Pension and Health Welfare.

 

9.         The Finance Committee shall be three members elected at large. The Chairman of the Finance Committee shall be the member who receives the highest number of votes

 

10.       The Executive Board shall consist of a total of five members one of which is the Vice-President, who is the Chairman of the Executive Board. The remaining four members of the Executive Board shall be elected by receiving the most votes.

 

11.       The installation of officers shall be at the January meeting of Local 111.

 

12.       In the event of a vacancy in any office except that of the President, the President shall fill the vacancy for the remainder of the unexpired term if the unexpired term is one year or less.  In the event of a vacancy in the office of President, the Business Manager shall fill the vacancy for the remainder of the unexpired term if the unexpired term is one year or less.  In the event of a vacancy in any office in which there is more than one year remaining in the unexpired term, a secret ballot election shall be held to fill the position.

 

13.       The Negotiation Committee shall be elected.

 

Finances

 

 

1.         No committee or members shall incur any expense to Local 111 without the majority vote of Local 111 at a regular or special meeting.

 

2.         Any member who handles Local 111’s moneys shall be bonded. Bond shall be paid by Local 111.

 

3.         Each year a Certified Public Accountant shall be employed to file all necessary L.M. Reports, State and Federal Tax Forms as required by law. Local 111’s Finance Committee shall employ a Certified Public Accountant as often as it deems necessary.

 

4.         The Business Manager/Financial Secretary shall be paid at least General Foreman’s rate of pay and all Business Agents, Organizer, etc. shall be paid at least the Foremen’s rate of pay wage and fringe benefits as negotiated in the U.P. UNION AGREEMENT.

 

5.         The salaries of the office employees of Local 111 shall be set as negotiated by the Business Manager/Financial Secretary.

 

6.         Any expenses incurred by an Officer, Business Manager/Financial Secretary, Business Agents, Organizer or members while performing the duties and transacting the business of Local 111 shall be reimbursed on the basis of actual expenses with proof of receipts or expense vouchers. The mileage rate shall be the Federal Rate for mileage.

 

7.         In the case of the death of a member of Local 111, Local is authorized to appropriate up to $50.00 for a floral arrangement. In the case of a death of an immediate family member of a member of Local 111, the Local is authorized to appropriate up to $35.00 for a floral arrangement.

8.         The Finance Committee shall meet once a month, and shall give their report at each Membership Meeting.

 

 

Initiations

 

 

1.         The initiation fee for a Journeyman’s Book shall be no more than $500.00.

 

2.         The initiation fee for a Journeyman’s Book for an organized established contractor shall be no more than $200.00.

 

3.         The initiation fee for an Apprentice’s Book shall be no more than $100.00.

 

4.         The initiation fee for a Metal Trades classification shall be no more than $100.00.

 

5.         All initiation fees may be reduced by the Business Manager/Financial Secretary of Local 111 if said action is for the best interest of Local 111 and the United Association. The initiation fee shall not be less than $50.00.

 

 

 

Ratification

 

1.         The membership of Local 111 shall vote by secret ballot or approved mail ballot on all collective bargaining agreements.

WORKING RULES and REFERRAL PROCEDURES

 

WORKING RULES

           

 

1.         Members shall not solicit their own work.

 

2.         No member shall install work coming under the U.A Jurisdiction (for personal gain) or for any one not signatory to the U.P. UNION AGREEMENT, except on their own property.

 

3.         Any member called to go to work by a contractor shall refuse unless the Business Manager or Business Agents are called first by the contractor. The Business Manager and Business Agents shall place all members.

 

4.         When the last journeyman employed on an industrial worksite is transferred from that job, this member shall contact the Business Manager/Agent at the time of transfer and inform him that there is no longer a Local Journeyman on the job.

 

5.         When a member is called by the Business Manager/Agent to take a job opening, they may have two (2) refusals. If a member does not accept a job after a second call the member shall be placed at the bottom of the hiring list, exception shall be for physical handicaps. Members promoting this violation will be subject to charges.

 

6.         A member shall be taken off of the hiring list for the following reasons: After working on one job for more than 120 hours or 15 working days, they will be put at the bottom of the hiring list; if they quit their job and they request a lay-off before their 15 working days have expired.

 

7.         When a member is laid off, it shall be their responsibility to call the Business Manager/Agent to be place on the out of work list. The day the member calls is when their name will be placed on the hiring list.

 

8.         No member shall come from another job to work overtime replacing another member already working on the job. Members promoting this violation will be subject to charges.

 

9.         Dues shall be $45 per month for working members and $35 per month for retired members or disabled members (with Social Security Award). Any retired member returning to work at any time shall pay working members dues.

 

 

 

REFERRAL PROCEDURES

 

 

The following referral procedure has been adopted by Local 111 effective, July 1, 2010, and shall remain in effect until amended or altered. This referral procedure, under the direction of the Business Manager, will be administered by the Business Manager or his designee, separately in each of four geographical areas of the Upper Peninsula:

 

            North:              Keweenaw, Houghton, Ontonagon, Baraga, Marquette

                                    and Alger Counties.

 

            South:              Menominee, Delta, and Schoolcraft Counties.

 

            East:                Luce, Chippewa, and Mackinac Counties.

 

            West:               Gogebic, Iron, and Dickinson Counties.

                                    (Including the Niagara, Wisconsin Paper Mill)

 

In the interest of maintaining an efficient system of production in the industry, providing for an orderly procedure of referral of applicants for employment, preserving legitimate interest of the employees and their status within the area and of preventing discrimination in employment because of membership or non-membership in the Union, all referrals shall be in accordance with the following procedure:

 

The Union shall maintain a separate register of applicants for employment, in each geographic area, established on the basis of groups listed above. Each applicant for employment shall be registered in the geographic area in which the applicant is a resident.

 

           

DEFINITIONS

 

 

“Resident” means a person who has maintained his permanent home in the above defined geographical area for a period of not less than three (3) years or who, having had a permanent home in this area, has temporarily left with the intention of returning to this area as his permanent home.

 

REFERRAL PROCEDURES (continued)

 

1.         Referral office hours. Applicants may register for referrals during normal business hours of the Union.

 

2.         Each applicant seeking referral shall advise the Union Business Manager of his or her name, address, classification, date of registration, telephone number and local union affiliation if applicable. The Business Manager may require proof of qualifications and any applicant making false statements or entries or using false documents is in violation of these procedures. Violation is grounds for charges against the violating applicant which may result in forfeiture of the applicant’s further use of this referral procedure.

 

3.         All applicants for referral shall be required to appear in person for registration. Persons registering for referral shall have their name maintained on such referral register so long as they register by telephone, U.S. Mail, or in person.

 

4.         The Business Manager shall refer applicants to the employer by first referring applicants, in order of their places on the out-of-work list.

 

5.         All applicants must provide a telephone number when registering as the use of the telephone will be the only method the Business Manager will use to attempt to communicate with applicants when making referrals.

 

6.         Each applicant has the right to exercise two (2) turn downs for a work referral, before being removed from the list and placed at the bottom of the list of his or her group after re-registration.

 

7.         Apprentices shall be hired and transferred in accordance with the apprenticeship provisions of the agreements between the parties and will not be governed by these procedures.

 

8.         Local 111 journeymen examination shall be given upon request. Person failing the examination shall be re-eligible for examination six (6) months from the time if their last testing.

 

9.         If a need exists, a Union Steward may be referred to employment at any job site regardless of where he/she is on the list.

 

APPEALS COMMITTEE

 

Persons feeling aggrieved by the above procedure or who feel that referrals have not been made in accordance with the above procedure shall have the right to bring such complaints to an Appeals Committee which is hereby established to be composed of the Union’s Grievance Committee.

 

It shall be the function of the Appeals Committee to consider any complaint of any employee or applicant for employment arising out of the administration by the Union of this referral procedure. The Appeals Committee shall have the power to make a final binding decision on any complaint which shall be complied with by the Union. The Appeals Committee is authorized to issue procedural rules to the conduct of his business, but is not authorized to add to, subtract from or modify any of the provisions of this referral procedure and its decision shall be in accord with this referral procedure.

 

All complaints by any applicants feeling aggrieved under this referral procedure shall be advanced and be presented in writing at the Union Hall within ten (10) days of knowledge by the applicant of any alleged improper referral.
